Terms of Service

1. Agreement to terms

By using Nevernix's website, chat widget, or voice agent — either as a client business or as someone contacting a business that uses Nevernix — you agree to these terms. If you're using Nevernix on behalf of a business, you're confirming you have authority to agree to these terms for that business.

2. What Nevernix does

Nevernix provides AI-powered chat and voice agents that answer, qualify, and book leads for service businesses. The agent is trained on information the client business provides and operates according to instructions configured by that business.

3. The AI can make mistakes — read this

Nevernix is powered by an AI language model. Like any AI system, it can occasionally misunderstand a request, give an incomplete answer, or make an error. It is not a substitute for professional advice (medical, legal, financial, or otherwise), and responses should not be relied upon as guaranteed accurate. Client businesses are responsible for reviewing how the agent represents them and for having a human follow up on anything the agent flags as uncertain or escalates.

4. Call recording

Voice conversations through Nevernix are recorded and transcribed, disclosed at the start of each call. See our Privacy Policy for details on how recordings are used, retained, and shared.

5. Client accounts and payment

• Client businesses are billed according to the plan selected at signup (monthly or annual).
• Subscriptions renew automatically until cancelled.
• New subscriptions may be cancelled and refunded in full within 7 days of initial signup, provided the onboarding call has not yet taken place. After that window, subscriptions are non-refundable for the current billing period, but you may cancel at any time to stop future billing.
• We reserve the right to suspend service for non-payment after reasonable notice.

6. Acceptable use

You may not use Nevernix to: deploy an agent for an illegal business or purpose, impersonate a person or entity in a misleading way, attempt to extract or misuse the underlying AI system, or use the service in any way that violates applicable law.

7. Intellectual property

Nevernix retains all rights to the underlying platform, software, and branding. Client businesses retain ownership of their own business information, branding, and any custom content they provide for their agent's configuration.

8. Limitation of liability

To the maximum extent permitted by law, Nevernix is not liable for indirect, incidental, or consequential damages arising from use of the service, including lost business or lost leads resulting from an agent error, downtime, or third-party service interruption (including our telephony and AI infrastructure providers). The service is provided "as is" without warranties of any kind.

9. Termination

Either party may terminate the service relationship at any time. We may suspend or terminate access immediately for violations of Section 6 (Acceptable Use).

10. Changes to these terms

We may update these terms as the service evolves. Continued use after a change means you accept the updated terms.
